The English court, which is currently reviewing the claim for the recovery of 135 million LVL from Aivars Lemebrs, neither decided to halt the litigation against him nor cancel the international arrest of his property in July 31.

The statement that was announced by Lembergs’ lawyer, Vineta Čukste, that the English court made the decision to recover 200 000 GBP from the bailiff in the interest of Lembergs, is considered as another hasty conclusion.

When deciding that the bailiff has an obligation to cover Lembergs’ litigation costs in the amount of 200 000 GBP, the English court made it clear that it will be done after the court has reviewed the appeal of the bailiff – the daughter company of Latvian Shipping Company, Pietiek reports.

As both sides of the conflict say – there is a long litigation process ahead of them. So the 200 000 GBP Lembergs’ lawyer hopes to recover from the bailiff, Čukste reports, is not the final amount Lembergs’ can hope to recover. «In reality, Lembergs’ was politely advised to back off, because as the practice of the English court shows, litigation costs that have been decided on are to be paid immediately, not after an appeal,»- a source close to the LSC court process told the portal.

A different source said that the decision made by the English court on Tuesday – to pay the litigation costs after the review of the appeal – means only the fact that no compensation is to be paid until the process is over, which is not expected to come any time soon: «Until the appeal process is over – and it is currently continuing – it is too soon to speak about paying any compensation. On top of that, the freezing of Lembergs’ assets is still in play. Only the English court is authorized to decide on the outcome of this case – not Lembergs’ lawyers.»

Several sources told the portal that opposite to Lembergs’ lawyer’s statements, the daughter companies of LSC submitted a number of appeals and these appeals «are being moved forward». With all this going on, Lembergs’ chances of avoiding the 135 million dollar case are considered slim.
