Prosecutor General's office: Lembergs breaches security measures

On May 31, the Prosecutor General’s office received a testimony with unfortunate news for the actual leader of the Greens’ and Farmers’ Union Aivars Lembergs, which will, most likely, be used to apply stricter security measures against the Mayor of Ventspils.

It should be said that the Prosecutor General’s office had made a number of steps in the past, which shows that the question of applying an appropriate security measure against Lembergs could soon be reviewed. The Prosecutor General’s office believes that Lembergs has breached the security measure restrictions to fulfill the duties of Chairman of Ventspils City Council and Chairman of the Board of Ventspils Free port, Pietiek.com writes.

It is thought that Lembergs was «duped» and the Prosecutor General’s office was largely provoked to act by his «posing» in front of TV cameras as the «owner» of Ventspils and creating the image that he is, in fact, the Mayor of the city. Also, his desire to enjoy the luxury of arriving to Court hearings in the Audi owned by Ventspils Free port did not help his case.

Chief Prosecutor Juris Jurisss of the public prosecutor group in Lembergs proceedings received the response from the Environmental Protection and Regional Development Ministry on the information related to Lembergs’ case, which the Prosecutor General’s office requested from the ministry in writing on April 24.

The testimony of Edmunds Spruds’ (Reform party) ministry could become fatal, because they prove the Prosecutor’s office’s suspicion about the breach of the imposed restrictions.

The most dangerous information for Lembergs in this document is the testimony that his «posing» as the «owner» of Ventspils in front of the public proves that Lembergs is, in fact, carrying out the duties of Chairman of Ventspils City council – which he not allowed to do.

«If a person publicly expresses views on matters related to a specific position – Municipal Council President inherent power, the person carries out these duties. Consequently, the ministry believes that a person who is publicly expressing opinions as a local government council chairman and is explaining the decisions taken by public authorities – this person is acting on behalf of the municipal council. Thus, the mentioned person carries out the duties of a Chairman of a Municipal Council», – stated in the testimony.

Prosecutor Juriss asks in his April 24 letter to the Environmental Protection and Regional Development Ministry to provide information on «whether or not Aivars Lembergs is actually carrying out the duties of Chairman of the board of Ventspils City Council by publicly expressing his opinion to society, media or during any other public events on matters in the City Council’s jurisdiction”.

According to the information available to Pietiek.com, the line in the ministry’s testimony that clearly states that Lembergs actually is carrying out the duties of the Mayor of Ventspils seriously startled the oligarch’s subordinates and lawyers.

It is unofficially known that an attempt to «back away» and not allow Prosecutor General’s office to take the steps to apply a stricter security measure against Lembergs, could be made by the politically «friendly» Justice Ministry, led by Gaidis Berzins (National union).

It is in the authority of the Justice Ministry to provide explanations of legal regulations (even though they carry no official weight, they are usually respected).
