Saeima approves significant amendments to the Labour Law

Baltic news, News from Latvia, BNN.LV, BNN-NEWS.COM, BNN-NEWS.RUThis Thursday, October 23rd, the Latvian Saeima approved significant amendments to the Labour Law, which provide new duties, responsibilities and rights to employers and employees.

The draft provides amendments in regard to contracts and job advertisements and information stated in them, weekends for blood donors, paying of vacation money, regulations in regard to labour and leisure and social security for employees with newborn children.

«Work on this law began with plans for a new model for overtime remuneration, because the current practice is not optimal. We see that many people work more than eight hours a day but do not have their overtime hours paid in double, as it should be in accordance with the law. We have tried asking our social partners to find a compromise solution to this, but neither drafts in the government, nor attempts to find a compromise with trade unions helped resolve this matter. Deputies respect the value of social dialogue and will not force either side to seek solutions. This is why no changes to overtime model will be added,» – explains the head of Saeima Social and Employment Matters Committee Aija Barča.

Amendments to the law provide an obligation to legal persons to state their company’s registration number in job advertisements. This will allow potential employees to receive more detailed information about the company, reports Saeima press-service.

Employment contracts will not be allowed to contain foreign language skills requirements unless the job requires the knowledge of a foreign language. Employment contracts are to be signed in Latvian language. In the event of a foreigner not having appropriate knowledge of Latvian language, the employer is obligated to inform the potential employee of requirements in written form.

In order to reduce illegal employment and prevent the possibility of fraud by signing employment contracts retrospectively, employers will be obligated to store employment contract and show them to authorities if need be.

Amendments also allow employers to prohibit employees to work if the employee is unable to perform his or her duties due to health problems. If there is a document signed by the employees doctor that proves bad health conditions, the employer will be obligated to remunerate the time the employee is not allowed to work.

The maximum amount of time a fixed-term employment contract will be allowed to be signed is 3-5 years.

The law also obligates employers to present employees a written order by which the latter can be dismissed.

Employees who have one or two children under the age of 14 have the right for at least one additional day of paid vacation per year.

In regard to weekends after donating blood, the law now states that the employee will be allowed to use this additional day off whenever he wants, but no later than one year after donating blood. The employer will be obligated to pay for no more than five days of vacation for donating blood per year. Current regulations do not provide any restrictions in regard to the number of days or validity.

Amendments also apply to the section of the Labour Law that provides employees with rights to short-term absence from work. By informing employers in a timely fashion, employees who have children under the age of 18 are allowed to be absent from work for a short period of time.

Amendments to the Labour Law will come into force January 1st, 2015.
